1. Acceptance of Terms
By accessing and using Indivieu's website or services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you may not access our website or use our services.
2. Description of Services
Indivieu provides digital marketing, technology, and business strategy services including, but not limited to: Digital marketing strategy and implementation Search engine marketing and optimization Social media marketing and management Business strategy consulting CRM setup and management App and MVP development Analytics and business intelligence setup All paid services are governed exclusively by a separate Trial Services Agreement, Statement of Work, and the Master Services Agreement (MSA).
2A. SMS Messaging Program
Indivieu, LLC — Indivieu provides SMS communications to opted-in contacts for purposes including appointment reminders, service updates, consultation follow-ups, marketing information about our digital marketing and business consulting services, and responses to inquiries submitted through our website or other channels. You can cancel the SMS service at any time. Just text "STOP" to +1 (888) 455-1486 . After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@indivieu.com or +1 (888) 455-1486 . Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your interaction and service needs.
3. Client Responsibilities
Provide accurate and complete information Maintain secure access credentials Respond to reasonable requests for information Provide necessary access to platforms, accounts, and systems Make all required payments under your applicable agreement
4. Payments & Billing
Payment terms for all paid services are governed only by your signed Trial Services Agreement, Statement of Work, and the MSA. Website usage alone does not create a billing relationship unless a separate written agreement is executed.
5. Intellectual Property
All website content, branding, proprietary systems, trademarks, and original works are the exclusive property of Indivieu, LLC unless otherwise stated in a signed agreement. Ownership of custom client deliverables is governed strictly by the applicable Trial Agreement and MSA.
6. Confidentiality
We maintain the confidentiality of non-public client information in accordance with the MSA and applicable law. Public website interactions do not create a confidential relationship unless governed by a signed agreement.
7. Limitation of Liability
To the maximum extent permitted by law, Indivieu shall not be liable for any indirect, incidental, special, or consequential damages arising from website use or general services. For paying clients, liability limitations are governed exclusively by the MSA.
8. Website & Service Modifications
We reserve the right to modify, suspend, or discontinue our website or general offerings at any time without notice. Active client agreements will be honored according to their governing agreements.
9. Termination of Website Access
We may terminate or restrict access to our website at any time for violation of these Terms, misuse, or unlawful activity. Termination of paid services is governed exclusively by the applicable Trial Agreement and MSA.
10. Dispute Resolution
All disputes relating to paid services, fees, performance, collection, or enforcement are governed exclusively by the MSA and signed client agreement. Disputes solely related to website usage shall be resolved in accordance with Texas law.
11. Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any website-related dispute shall be resolved exclusively in Travis County, Texas.
12. Changes to Terms
We may update these Terms at any time. Continued use of the website after changes constitutes acceptance of the revised Terms.
